1ClickProduct - Terms of Service

Effective Date: February 16, 2026

By installing, accessing, or using the 1ClickProduct Shopify application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must uninstall the App and discontinue use immediately.

1. The App Service

1ClickProduct is a Shopify application that enables merchants to import product information from external e-commerce platforms (including but not limited to Amazon, AliExpress, and eBay) into their Shopify store. The App provides tools to:

• Retrieve publicly available product data (titles, descriptions, images, pricing) from third-party URLs
• Rewrite and translate product content using AI
• Adjust pricing with currency conversion and markup rules
• Publish imported products to your Shopify store

2. Eligibility

To use the App, you must:

• Have a valid and active Shopify store
• Be authorized to install applications on that store
• Be at least 18 years old or the age of majority in your jurisdiction
• Agree to comply with Shopify's Terms of Service and Acceptable Use Policy

3. User Responsibility for Imported Content

3.1 Ownership and Permission. You are solely responsible for all content you import, modify, and publish to your Shopify store using the App. By importing a product, you represent and warrant that you:

• Own the rights to the product content (titles, descriptions, images), OR
• Have obtained all necessary permissions, licenses, and consents from the rights holder to use, reproduce, and publish the content on your store

3.2 Compliance. You agree that you will not use the App to import or publish content that:

• Infringes on any third party's intellectual property rights, trademarks, or copyrights
• Violates any applicable laws or regulations
• Is fraudulent, misleading, or deceptive
• Contains illegal, harmful, or prohibited material
• Violates the terms of the source platform (Amazon, AliExpress, eBay, etc.)

3.3 Review Before Publishing. You must review all product listings, including any AI-generated or AI-rewritten content, before publishing them to your store. It is your responsibility to ensure accuracy, legality, and appropriateness of all published content.

4. No Liability for Imported Content

The App is a tool that facilitates the import and editing of product information. We do not verify, endorse, or assume any responsibility for:

• The legality or ownership status of any content you import
• Whether you have the right to sell the products you list
• The accuracy, completeness, or truthfulness of imported product data
• Any disputes, claims, or legal actions arising from your imported content

You acknowledge that importing product content from third-party platforms may involve intellectual property owned by others, and that you use this functionality entirely at your own risk.

5. AI Content Disclaimer

The App includes AI-powered features for rewriting product titles and descriptions, and for translating content between languages. You acknowledge that:

• AI-generated content is provided "as is" and may contain inaccuracies, errors, or inappropriate material
• AI-generated content does not constitute professional advice of any kind
• You are solely responsible for reviewing and approving all AI-generated content before publishing
• We make no guarantees regarding the quality, accuracy, or suitability of AI-generated content for any purpose

6. Billing and Subscriptions

The App offers free and paid subscription plans:

• All billing is processed through Shopify's billing system. By selecting a paid plan, you authorize Shopify to charge your account on a recurring basis
• You may cancel your subscription at any time through the Shopify Admin. Cancellation takes effect at the end of your current billing period
• Refunds are handled in accordance with Shopify's billing policies
• We reserve the right to change pricing with reasonable notice. Existing subscribers will be notified before any price changes take effect

7. Usage Limits

Each subscription plan includes specific product import limits per billing cycle. If you reach your plan's limit:

• You will be unable to import additional products until your usage resets or you upgrade
• Usage counts reset monthly based on your billing cycle (or on the 1st of the month for free plans)
• Upgrading to a higher-tier plan takes effect immediately and provides the new plan's limits

8. Account and Security

The App accesses your Shopify store through Shopify's authenticated session token mechanism. You are responsible for:

• Maintaining the security of your Shopify account credentials
• All activity that occurs through the App on your store
• Notifying us immediately if you suspect unauthorized access

9. Indemnification

You agree to indemnify, defend, and hold harmless 1ClickProduct, its owners, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the App
• Content you import, modify, or publish using the App
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any dispute between you and a third party regarding imported content

10. Intellectual Property

All rights, title, and interest in and to the App (excluding content you provide) remain with 1ClickProduct and its licensors. You may not copy, modify, distribute, sell, or reverse-engineer any part of the App. Your use of the App does not grant you ownership of any intellectual property rights in the App or the content you access through it.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied
• We do not warrant that the App will be uninterrupted, error-free, or free from harmful components
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill
• Our total aggregate liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim

12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if:

• You violate these Terms
• Your use of the App poses a risk to us, other users, or third parties
• Continued provision of the App becomes impractical or commercially unviable

You may terminate your use at any time by uninstalling the App from your Shopify store. Upon termination, your right to use the App ceases immediately. Products already published to your store are not affected by termination.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via the email associated with your Shopify account. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the changes, you must uninstall the App.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
